Most cargo vans stay well under the thresholds, but not all of them, and the answer changes what the business must do.

Federal safety rules treat a vehicle used in interstate commerce as a commercial motor vehicle at 10,001 pounds gross vehicle weight rating or combination rating (49 C.F.R. § 390.5T). Heavy-duty vans and any van pulling a loaded trailer can cross that line on the combination rating even when the van alone does not.

Florida's own commercial motor vehicle definition sits higher, at 26,001 pounds or three or more axles (s. 320.01(25), Fla. Stat.), so a standard cargo van is outside the weight-based liability tiers in s. 627.7415. FMCSA also lists Florida among the states requiring intrastate commercial motor vehicle registrants to obtain a USDOT number, so any van crossing the federal threshold should be reviewed rather than assumed.
